Welcome to Mags Custom Design (“we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your use of our website, www.magscustom.com (the “Site”), and the purchase of any products or services offered on the Site, including but not limited to custom laser engraving, custom apparel, and other personalized items (“Products”).

By accessing our Site, creating an account, or purchasing Products, you agree to be bound by these Terms and our separate Privacy Policy. If you do not agree to these Terms, do not use our Site.

2. Eligibility

You must be at least 18 years old to use our Site and purchase Products. By using our Site, you represent and warrant that you are of legal age to form a binding contract with us.

3. Accounts

You may be required to create an account to access certain features. You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Product Sales and Payment

  • Pricing: All prices are listed in U.S. Dollars. We reserve the right to change prices for Products at any time without notice. Such changes will not affect orders that have already been accepted.
  • Payment: We use third-party payment processors (e.g., Stripe, PayPal) to handle all transactions. You agree to provide current, complete, and accurate purchase and account information. You authorize us (and our third-party payment processors) to charge your selected payment method for the total amount of your order, including any applicable taxes and shipping fees.
  • Order Acceptance: We reserve the right to refuse or cancel any order for any reason. This may include, but is not limited to, limitations on quantities available, inaccuracies in product or pricing information, or issues identified with your payment. We will not charge you for orders we do not accept.

5. Custom Orders and User-Submitted Content

This section governs any text, logos, images, designs, or other content you provide to us for personalization (“User Content”).

  • Responsibility for Content: You are solely responsible for your User Content. You represent and warrant that you own or have all necessary rights, licenses, and permissions to submit the User Content and to grant us the rights to use it as described in these Terms.
  • Intellectual Property Warranty: You agree that your User Content will not infringe upon or violate the rights of any third party, including copyright, trademark, privacy, or other personal or proprietary rights. You agree not to submit any content that is unlawful, hateful, defamatory, or obscene.
  • License to Mags Custom Design: By submitting User Content, you grant us a limited, non-exclusive, royalty-free, worldwide license to use, reproduce, modify, and display the User Content solely for the purpose of designing, manufacturing, and fulfilling your order.
  • Right to Refuse: We reserve the right to refuse to produce any order that contains User Content which, in our sole discretion, we deem to be unlawful, infringing, or otherwise in violation of these Terms.
  • Indemnification for Content: You agree to indemnify, defend, and hold harmless Mags Custom Design and its affiliates, officers, and employees from any and all claims, liabilities, damages, and costs (including reasonable attorneys’ fees) arising from a claim that your User Content infringes or violates the rights of a third party.

6. Shipping and Risk of Loss

All shipping dates are estimates only. All Products purchased from us are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the shipping carrier (e.g., USPS, UPS, FedEx).

7. Returns and Refunds

  • Non-Personalized Items: Returns for non-personalized, non-custom items may be accepted within [Insert Number, e.g., 14 or 30] days of delivery, provided the item is unused and in its original condition and packaging. Please contact us to initiate a return.
  • Custom and Personalized Items: Due to their unique nature, all sales of custom or personalized Products are final. We cannot accept returns or offer refunds unless the Product is defective or we made an error in the personalization that does not match the information you provided.
